In addition to our duty of confidentiality to customers, HSBC Institutional Trust Services (Asia) Limited 滙豐機構信託服務（亞洲）有限公司 ("HSBC"), as the trustee and/or administrator of pension schemes, shall at all times fully observe the Personal Data (Privacy) Ordinance ("the Ordinance") of the Hong Kong SAR in collecting, maintaining and using personal data of customers. The following terms set out our privacy policy of the personal information provided by you ("user") to this site:

1. From time to time, it is necessary for the user to supply HSBC with data such as in connection with the opening or continuation of accounts or provision of services to the user.



2. Failure to supply such data may result in HSBC being unable to open or continue an account or to provide services to the user.



3. It is also the case that data are collected from the user in the ordinary course of the continuation of the relationship between the user and HSBC.



4. The purposes for which data relating to the user may be used are as follows:
   
   Non-MPF members with respect to non-MPF data,
   
   
   1. the daily operation of the services provided to the user;
   2. marketing related products or services to the user. (however the user may elect not to receive educational and/or marketing information on products or services by contacting our Data Protection Officer as indicated at the bottom of this statement);
   3. for the purposes of any party (or a party related to such party) having at any time obligations under the relevant scheme in relation to the user, for example but not limited to calculating an Employer's long service or severance payment accrued liability in respect of a user at any time;
   4. meeting disclosure requirements under any laws binding on HSBC or any of their affiliates;
   5. any purpose related to the administration of the relevant scheme or the data subject's participation therein; and;
   6. any other purpose directly related to the above.
   
   
   MPF members with respect to MPF data,
   
   
   1. the daily operation of the MPF services provided to the user;
   2. marketing MPF related products or services to the user. (however the user may elect not to receive educational and/or marketing information on products or services by contacting our Data Protection Officer as indicated at the bottom of this statement);
   3. for the purposes of any party (or a party related to such party) having at any time obligations under the relevant MPF scheme in relation to the user, for example but not limited to calculating an Employer's long service or severance payment accrued liability in respect of a user at any time;
   4. meeting disclosure requirements under any laws binding on HSBC or any of their affiliates;
   5. any purpose related to the administration of the relevant MPF scheme or the data subject's participation therein; and;
   6. any other purpose directly related to the above.



5. Data collected as described above may be maintained for such period of time which may be required under the applicable law and as otherwise needed to fulfill the purposes set out under paragraph (d) above.



6. Data held by HSBC relating to the user will be kept confidential but HSBC may provide such information to the following parties whether inside or outside Hong Kong for the purposes set out in paragraph (d):
   
   
   1. the ultimate holding company of HSBC and/or its subsidiaries and/or affiliates;
   2. the service providers of HSBC including any fund manager under the relevant scheme in order to answer user enquiries;
   3. the employees, officers, directors and agents of HSBC or any of the parties in (i) to (ii) above;
   4. the intermediaries of HSBC; and
   5. any party (including, but not limited to, any regulatory authority) entitled thereto by law or regulation (whether statutory or not).



7. Under the Personal Data (Privacy) Ordinance, any individual has the right:
   
   
   1. to check whether HSBC holds data about him/her and to gain access to such data;
   2. to require HSBC to correct any data relating to him/her which are inaccurate;
   3. to ascertain HSBC's policies and practices in relation to data and to be informed of the kind of personal data in respect of him/her held by HSBC;
   4. to object to the use of his/her personal data for marketing purposes; in which case HSBC will not use his/her personal data for these purposes if he/she communicates his/her objection to HSBC.



8. In accordance with the terms of the Personal Data (Privacy) Ordinance, HSBC has the right to charge a reasonable fee for the processing of any data access request.
